Draft Statues of Center of Exploration and Revelation

  第一章 总则
Chapter 1 General Principles

  第一条 为规范特区政府的行政决策程序,提高行政决策的科学性和民主性,保护公民、法人和其他组织的合法权益,促进特区政府依法行政,制定本章程。
Article 1: In order to regulate the administrative decision-making procedures of the Special District Government, enhance the scientific and democratic nature of administrative decision-making, protect the legitimate rights and interests of citizens, legal entities, and other organizations, and promote the Special District Government to administer according to the law, these statutes are formulated.

  第二条 本章程适用于特区政府及其职能部门在经济社会发展、公共服务、环境保护等方面的重大行政决策。
Article 2: These statutes apply to the major administrative decisions in economic and social development, public services, environmental protection, and other aspects made by the Special District Government and its functional departments.

  第三条 行政决策应当遵循以下原则:
Article 3: Administrative decision-making should follow the following principles:
(一)合法原则:行政决策应当遵守法律法规,维护国家法制的统一和尊严。
(1) Principle of legality: Administrative decision-making should comply with laws and regulations to maintain the unity and dignity of the national legal system.
(二)合理原则:行政决策应当符合科学、理性、和公正的要求。
(2) Principle of rationality: Administrative decision-making should meet scientific, rational, and fair requirements.
(三)民主原则:行政决策应当充分听取各方面的意见,尊重民意。
(3) Principle of democracy: Administrative decision-making should fully listen to opinions from all sides and respect public opinion.
(四)效率原则:行政决策应当注重效率,提高决策质量和效率。
(4) Principle of efficiency: Administrative decision-making should pay attention to efficiency and improve the quality and efficiency of decision-making.

  第二章 决策程序
Chapter 2 Decision-making Procedures

  第四条 重大行政决策应当经过以下程序:
Article 4: Major administrative decisions should go through the following procedures:
(一)调查研究;
(1) Investigation and research;
(二)公众参与;
(2) Public participation;
(三)专家论证;
(3) Expert debate;
(四)风险评估;
(4) Risk assessment;
(五)合法性审查;
(5) Legality review;
(六)集体讨论。
(6) Collective discussion.

  第五条 行政决策的调查研究应当广泛收集信息,全面分析数据,科学预测影响,并形成调查报告。
Article 5: The investigation and research of administrative decision-making should widely collect information, comprehensively analyze data, scientifically predict impacts, and form an investigation report.

  第六条 行政决策的公众参与应当充分保障公民、法人和其他组织的知情权、表达权和监督权。
Article 6: The public participation in administrative decision-making should fully protect the right to know, express, and supervise of citizens, legal entities, and other organizations.

  第七条 专家论证应当组织相关领域的专家对行政决策事项进行专业分析和评估,并提出意见和建议。
Article 7: Expert debate should organize experts in related fields to professionally analyze and evaluate administrative decision-making matters and put forward opinions and suggestions.

  第八条 风险评估应当对行政决策事项可能产生的社会、经济、环境等方面的影响进行预测和评估,并提出相应的应对措施。
Article 8: Risk assessment should predict and evaluate the possible social, economic, environmental impacts of administrative decision-making matters and propose corresponding measures.

  第九条 合法性审查应当对行政决策事项是否符合法律法规进行审查,并出具合法性审查意见。
Article 9: Legality review should review whether administrative decision-making matters comply with laws and regulations and provide a legality review opinion.

  第十条 集体讨论应当充分听取各方面的意见,并在综合考虑各方面因素的基础上作出决策。
Article 10: Collective discussion should fully listen to opinions from all sides and make decisions based on comprehensive consideration of various factors.

  第三章 决策的公布和实施
Chapter 3 Announcement and Implementation of Decisions

  第十一条 行政决策应当在作出后七个工作日内向社会公布,并明确公布方式、公布范围和公布期限。
Article 11: Administrative decisions should be announced to the public within seven working days after being made, and clarify the method, scope, and period of announcement.

  第十二条 行政决策的实施应当明确责任主体、实施步骤和完成时限,并进行监督检查。
Article 12: The implementation of administrative decisions should clarify the responsible entity, implementation steps, and completion deadline, and carry out supervision and inspection.

  第四章 监督和责任
Chapter 4 Supervision and Responsibility

  第十三条 行政决策的监督应当包括内部监督和社会监督。
Article 13: The supervision of administrative decisions should include internal supervision and social supervision.

  第十四条 行政决策的内部监督应当由上级主管部门或行政监察部门进行,并定期向社会公布监督结果。
Article 14: Internal supervision of administrative decisions should be conducted by higher authorities or administrative inspection departments and regularly announce supervision results to the public.

  第十五条 行政决策的社会监督应当鼓励公民、法人和其他组织对行政决策的实施提出意见和建议。
Article 15: Social supervision of administrative decisions should encourage citizens, legal entities, and other organizations to propose opinions and suggestions on the implementation of administrative decisions.

  第十六条 对于违反本章程的行政决策,应当依法追究相关责任人员的法律责任。
Article 16: Administrative decisions that violate these statutes should be held legally liable for the responsible personnel.

  第五章 附则
Chapter 5 Supplementary Provisions

  第十七条 本章程自发布之日起实施。
Article 17: These statutes shall be implemented from the date of publication.

  第十八条 本章程的解释权归新澳门王中王100%期期中探索与揭秘委员会所有。
Article 18: The right to interpret these statutes belongs to the Center of Exploration and Revelation of New Macau King.
